The U.S. Court of Appeals for the Ninth Circuit refused to rehear Newsom v. Trump en banc, leaving in place a ruling that allows Trump to retain command of California National Guard troops he federalized during the Los Angeles protests earlier this year.
The Ninth Circuit’s move leaves intact a decision that could reshape the balance of power between the White House and blue-state governors who try to block federal crackdowns.
The ruling also sets a high-stakes precedent: future presidents may now have a freer hand to deploy state-controlled troops when protests spin out of control — whether the local politicians like it or not.
